Abstract

The present article aims to analyze the complex notion of property in Hegel's work, with particular emphasis on its nuanced presentation in the Rechtsphilosophie through three conflicting and related stages of development: abstract law as the justifying germ of private property and intersubjective contract, which, however, still falters against the dissolutionary potential of the right of heroes; civil society as the advent of the solid legal guarantee of property rights in its intermediate institutions, but also as the tension staged in the problem of the rabble; and the State as the reconciling culmination of the legal guarantee coupled in limite to the internal and external disintegration of property rights. Through this exploration, it will be further shown how the conflicting role of property makes possible a circular and heterodox interpretation of the conceptual structure of the work, while allowing fruitful correspondences with the tradition.
