De manera muy reciente, la sentencia del TSJ de Cataluña núm. 496/2023, de 30 de enero (rec.6219/2022) ha venido a reconocer la necesaria existencia de una indemnización adicional, por encima de la tasada legalmente, para otorgar efectos disuasorio y reparador a una acción extintiva por parte del empleador.
