The Prohibition of Discrimination in Employment
Notes on its Construction, Evolution and Current Situation in Comparative Law and Mexican Legislation

This article reviews the principle of non-discrimination, its causes, the disparate treatment, disparate impact and the affirmative actions. It also analyzes the scope of non-discrimination in labor relations and its procedural aspects; the flexibilization of the onus probandi, the procedures to attend discriminatory treatments, and a brief review of some of the most important cases of the Supreme Court of the Mexican Nation. The study ends with a reference to this right in times of pandemic and its treatment.
