La garantía de indemnidad es una institución jurídica propia del orden laboral. Mediante ella se persigue proteger al trabajador que ha efectuado cualquier reclamación frente al empleador. Se busca dotar de garantías a quien denuncia una situación que considera injusta y lo hace desde una posición de debilidad. Tiene que ver con la función tuitiva del Derecho del Trabajo y supone la construcción de un entorno de seguridad de protección para quien activa cualquier acción.
