Jurisprudential interpretation of the referral clause of the crime "against the safety of workers" (art. 316 of the Spanish Penal Code)

This article studies, within the framework of the typical complex structure of art. 316 of the Spanish penal Code (crime against the safety of workers), the relationship between the “(serious) criminal danger” required by the type and the “(serious) administrative danger”, consequence of the administrative offense, to which the precept refers, in its character as a "blank criminal norm". Different jurisprudential positions are analyzed.
