Abstract

CJEU analyzes again the recurring issue of the system of public benefits in Spain and its respect for the principles of the EU. In the present case, the collision between a regulation that generates indirect discrimination and its justification by social policy objectives is studied. CJEU, in a highly debatable resolution, concludes that Spanish legislation is respectful of the principle of equality.
