Abstract

The child friendly justice argues in favour of a justice system which guarantees the respect and the effective implementation of all children’s rights. The effects that the imprisonment of the children’s primary caregiver has on them are usually devastating. Therefore, it becomes necessary to introduce in our Criminal justice system all the measures that can, at least, minimise the harmful effects that the imprisonment of the main caregiver may cause on children. Consequently, this paper analyses the potential measures to be taken against the primary caregiver of a child from the beginning of the Criminal proceedings to, if necessary, the enforcement of the sentence.
