Are theories of desistance and their practical implications dependent on the structural context?

Abstract

The paper discusses whether theories of desistance and their preventive implications are universal or dependent on the structural characteristics of the context. Of course, theories of desistance, like criminological theories in general, identify social-psychological
mechanisms that are generally relevant for understanding human behaviour. But these causal mechanisms are triggered by certain factors that may be more or less prevalent depending on the context. In the same way, the effectiveness of certain preventive institutions may also depend on the existence of certain structural conditions. In this paper, I give some examples of this structural dependence of theories of desistance and their practical implications, and I analyse whether some structural characteristics of Spanish society -such as familism or the inclusive nature of the prison system- could explain the importance of the theory of social support in understanding desistance in our context, and the role played by community service of the prison sentence.
