Methodology of developing legal research papers from a practical approach. The value of professional experience

Abstract

The present article intends to be an analysis of the methods of the legal research and it is made from a practical approach. In a scope of the scientific research, which is traditionally characterised by having an essentially theoretical orientation, some changes in the perspective are considered convenient in order to guide the investigation towards a solution of the real problems that the application of the law implies. In that sense, this approach places the problem as the origin and guiding force of the research, so the conclusions obtained can give a real answer to the disagreements originated by the legal institutions.
According to this, in the present work, the different stages and elements of the juridical research work are analysed, through the previously mentioned practical approach, particularly in the doctoral theses. The article concludes with a reference to the professional experience as a specially useful resource in the researching work.
