Abstract

The document analyzes the legal and economic aspects of an optimized management model for a Dynamic Collaborative Wine Tourism Ecosystem (EECD). This model aims to boost profitability and sustainable local development through collaboration, the integration of technology, and a solid, adaptive legal framework. The Economic Interest Grouping (EIG/AIE) is proposed as the suitable legal entity to structure the central body or Hub/Nexo, highlighting its auxiliary purpose to its members and flexibility. The use of Artificial Intelligence (AI) must comply with Regulation (EU) 2024/1689 (AI Act), which provides legal certainty, supports innovation, and establishes requirements and transparency obligations. Personal data protection is essential, in accordance with Organic Law 3/2018 (LOPDGDD) and the GDPR, which guarantees individual rights and defines the principles and bases of lawful processing. Other essential legal aspects include the clear distribution of responsibilities in joint actions and the establishment of transparent payment/commission models for cross-selling and joint products.

Author Biography

Manuel Velasco-Carretero, Facultad de Derecho de Málaga

Having joined the school late due to the need for collaboration in the family agricultural and livestock economy, he has worked as a shepherd, apprentice farmer, waiter, law firm intern, account executive, business graduate, economist, lawyer, internal audit director (at Euromarket), general manager of cooperatives (at Punta Paloma-donut and Scaavo-Hojiblanca), general secretary of business organizations (Cecap Andalucía - FACEP), partner of the venture capital entity M Capital (owned by Unicaja, Cajamar, BBVA, Cajasur...) in Interempleo and in Integrated Consulting Business Services (Sercoda) and director of trade houses (Oficios en la casa del Vino and Málaga Recurso Enológico), among other dedications. He is currently pursuing an inter-university doctorate in Legal and Social Sciences (Tourism) while also being a PSI - PDI professor in the Department of Public Law (areas of Administrative Law and Criminal Law) at the University of Malaga (UMA) and a researcher via the Research Results Transfer Office - OTRI-UMA, having worked in Compliance, teaching, consulting, law and bankruptcy administration.
