Abstract

The current intellectual property regime hinders the capacities of states and governments, especially in developing countries (DCs), in their access to scientific and technological advances and medicines, to the detriment of the exercise of fundamental human rights such as the Right to Health and the Right to Health Care, making it crucial to correct this imbalance.

States and Governments have an inescapable obligation to protect, promote and respect the right to health of their citizens by safeguarding conditions that allow all people to live as healthily as possible. The right to health should not be understood only as the right to be healthy, but rather as the enjoyment of the highest attainable standard of health by making timely, acceptable and affordable access to health services and sufficient, safe and acceptable quality means possible.
