Abstract

The life of prisoners with serious and incurable terminal illnesses, whose desire to obtain their cherished freedom is to die with dignity in freedom, is a permanent dilemma; this scenario leads us to question: How do current legislation and prison practices in
Peru address the right of terminally ill prisoners to die with dignity in freedom? Indeed, the study addresses the denial of early release as a possible violation of the fundamental rights of these prisoners, especially the right to die with dignity. This paper examines the Peruvian legal framework and compares it with legislation in other countries that have implemented measures to guarantee the release of prisoners in similar situations.
