Are Immigration Detention Centers Legitimate?

Abstract

The immigration detention centers are defined by Law on foreigners as centers of a non-penitentiary nature that play a precautionary role to ensure the deportation or return of the foreign who break the Law on foreigners. However, these centers have a clearly penitentiary mark and nature, with non-compliance of the legal requirements and, also, become meaningless in their task of precautionary goal for which they were thought for. Therefore, it would be best to dispense with those centers and enhance non-custodial precautionary measures such as retention of personal documentation, obligation to periodically appear in person, housing in reception centers under social organizations or any other non-custodial measures.
