One of the most essential characteristics of non-contributory benefits, both in Spain and in European Union law, is their territoriality. The same is true in the United States, where federal non-contributory benefits are limited to residents of the 50 States and the District of Columbia. The United States Supreme Court itself has recently confirmed this territoriality, validating the legal exclusion of residents of Puerto Rico from access to such federal non-contributory benefits.
