Abstract

Introduction: It is an undeniable fact that sports practice in Mexico is carried out in abundance at different levels, from popular to high performance or professional. Already Despite this, few are those who really know the governing bodies of this activity, as well as the Sports Appeal and Arbitration Commission. Objectives: The main objective of this writing is to carry out an analysis of two alternate means of solving controversies, which can be applied effectively in sports matters: the mediation and arbitration. Method: For this, a descriptive study of these concepts, introducing the different definitions and fundamental principles that govern these procedures. In the same way, a brief analysis of the legislation Mexican law on sports (General Law of physical culture and sports) describing the legal regime of mediation and arbitration within the Mexican regulations. It will describe the nature of the sports appeal and arbitration commission, a Mexican body of administration of justice. Next, various problems that this commission faces according to the theories of various jurists specialized in sports matters within Mexico, as well as possible solutions that are proposed to solve these problems. Results: Mediation and arbitration applied in sports are an effective solution for excellence to the problems that arise in the sports field. The appeal committee and sports arbitration, the main body for imparting "sports justice" in Mexico, in its regulations recognize different types of procedures such as mediation or arbitration, not However, in this situation, the cases brought before it are very limited. Conclusions: This commission should have greater powers of coerciveness to be able to function effectively in Mexico, since by not lacking its own binding force it generates a feeling of "simulation" in their behavior.
